Your Conduct
Unacceptable actions and content, further described below, will constitute grounds for blocking your access to our service, removal of posted material and non-fulfillment of your order. As condition of your use of this service, you shall not:

(c) Harm minors in any way;
(d) Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through this site;
(e) Upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software;
(f) Interfere with or disrupt (or attempt to interfere with or disrupt) this site or servers or networks connected to this site, or disobey any requirements, procedures, policies or regulations of networks connected to this site;
(g) Exhibit expressions of abuse that could give rise to any civil or criminal liability under applicable State or Commonwealth law, or violating any laws or regulations of any governing body having jurisdiction over musicforte.com, its affiliates or users.
Spam
Any musicforte.com customer found to be using musicforte.com products, services or information for spamming purposes may, at the discretion of musicforte.com, be immediately cut off from use of all musicforte.com products and services and/or fined, with no refund of fees that have been paid. By participating in spamming activities, you will be subject to the loss of musicforte.com services, fines and possible legal action.
No Monitoring of Content
musicforte.com does not have any obligation to monitor the music and lyrics. All content provided by a user of this service is expected to meet the guidelines as expressed in these terms and conditions.
DISCLAIMER OF WARRANTY AND LIMITATIONS OF LIABILITY
THE FOLLOWING STATEMENT DOES NOT TAKE AWAY ANY RIGHTS YOU MAY HAVE UNDER THE TRADE PRACTICES ACT OR EQUIVALENT STATE LEGISLATION.
To the extent permitted by law, this site and all products and services provided by musicforte.com are provided "as is" with no warranties whatsoever, and all express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement, are expressly disclaimed.
musicforte.com disclaims any warranties for the security, reliability, timeliness, and performance of this service.
You, the user, understand and agree that the submission of any musical works to musicforte.com, and the download of any material through musicforte.com service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that may result in the download of any material.
In the event we agree the quality of your music project is not satisfactory, we will gladly intervene so that an agreed resolution can be made. (Note: the quality of the music is dependent on the quality of your musical direction, and by the agent(s) you have agreed to hire for the project.) The ten percent corporate fee that is added to project costs is non-refundable.
Except as expressly provided in the preceding paragraph, to the fullest extent allowed by law, musicforte.com shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, and punitive damages, even if musicforte.com has been advised of the possibility of such damages. The foregoing disclaimers, waivers and limitations shall apply notwithstanding any failure of essential purpose of any limited remedy. No additional liability or responsibility is accepted for handling commercial, academic or professional work if permission for use has not been granted or approved.
Refund Policy
Refunds for Platinum services may be issued for no longer than a 30-day period from the date of your order. A written explanation must be received that states why a refund is being requested. All requests are considered on a case by case basis. If a refund will not be issued, we will send (to the registered email address) the reason of denial. Any refund requests or disputes should be mailed to billing@musicforte.com.
Refunds for musician services are considered on a case by case basis. Music Forte will use the best of our ability to promote and sell CDs of our registered artists. However, if the artist does not supply the necessary product or if the member no longer chooses to sell their product through Music Forte, the product will simply be made unavailable through our storefront. A written explanation must be received that states why a refund is being requested. All requests are considered on a case by case basis. If a refund will not be issued, we will send (to the registered email address) the reason of denial. Any refund requests or disputes should be mailed to billing@musicforte.com.
Music Mart Refunds - We do want you to be happy with your order. If your product is defective, unopened, or if Music Forte sent an incorrect item as OUR error, we give you 30 days from the date we shipped your order to return a product purchased from us for either a store credit or a refund of the purchase price - your option. We also refund shipping costs if the return is due to our error or the product was defective. Returned products must be in original condition with no markings, folded or creased pages. Any product returned in less than "like new" condition may be refused refund. Due to manufacturer restrictions, media and software products (such as videos, DVD's, CDs, cassettes, and floppy disks) must be unopened in their original manufacturer-sealed plastic shrink-wrap to be returnable. Please include a copy of your packing slip and a brief explanation of the reason for your return and/or the defect in the product. Delivery confirmation and insurance on your return are strongly recommended. Send your return to:

No Chargebacks; Anti-Fraud Policy
Client understands that no chargebacks of any kind are allowed. MusicForte deems unauthorized chargebacks as consumer fraud and will proceed to collect by any means necessary. Client is responsible for attorney's fees, fees for collection agencies or third party intervention if client charges back or does not pay monies owed. Client must contact MusicForte by phone to obtain authorization to chargeback/cancel any order. If Client charges back without following proper procedure, Client will pay MusicForte $500 in chargeback fees together with all other amounts owed. MusicForte will report any outstanding balances to the three main credit bureaus and will have the incident reported to anti-fraud databases which will prevent any further purchases on the Internet
Cancellation Policy
Members can cancel anytime. If you are a member of our "Platinum Plan", billing will be cancelled immediately with your cancellation request. Please send an email to support@musicforte.com, or call Toll-Free at (888) 659-2867 (US and Canada).
General Terms
All legal issues arising from or related to the use of this service shall be construed in accordance with the laws of the State of Illinois (United States.) These Terms of Service constitute the entire agreement between you and musicforte.com with respect to the use of this service. Failure by musicforte.com to enforce any right or provision in these Terms of Service shall not constitute a waiver of such right or provision or of any other rights or provisions in these Terms of Service. If a court should find that one or more rights or provisions set forth in these Terms of Service are invalid, you agree that the remainder of the Terms of Service shall be enforceable and that the invalid provision shall be enforceable to the fullest extent permitted by law. All prices quoted are in United States dollars.
